other intellectual property rights. You may store, print and display the content
supplied solely for your own personal use. You are not permitted to publish,
manipulate, distribute or otherwise reproduce, in any format, any of the content
or copies of the content supplied to you or which appears on this Website nor
may you use any such content in connection with any business or commercial
enterprise. You may not otherwise
reproduce, modify, copy or distribute or use for commercial purposes any of the
materials or content on the Retrosun Sunglasses Website without written permission from
Retrosun.
No licence or consent is granted to you in these Terms and Conditions to use any
trade mark of Made for Sun ltd T/A Retrosun or its affiliated companies.
5. Terms of Sales
By placing an order for Retrosun sunglasses you are offering to purchase a
product on and subject to the following terms and conditions. All orders are
subject to availability and confirmation of the order price.
By making an order with Retrosun sunglasses you are confirming that you are aged
18 years or over and possess a valid credit or debit card issued by a bank
recognised by us.
(a) Placing an order
When you place an order, you will receive an acknowledgement e-mail confirming
receipt of your order: this email will only be an acknowledgement and will not
constitute acceptance of your order. A contract between us will not be formed
until we send you confirmation by e-mail that the goods which you ordered have
been dispatched to you. Only those goods listed in the confirmation e-mail sent
at the time of dispatch will be included in the contract formed.
(b) Pricing
The prices payable for the products that you order are clearly set out on the
relevant part of the Retrosun Website. If, by mistake, we have under priced an
item, we will not be liable to supply that item to you at the stated price,
provided that we notify you before we dispatch the item concerned. In those
circumstances we will notify the correct price to you so you can decide whether
or not you wish to order the item at that restated price. If you decide not to
order the item, we will give you a full refund on any amount already paid for
that item in accordance with our refund policy in clause 6.2 below.
Prices on the Retrosun Website include UK
VAT for all EU customers. For customers outside the EU, Retrosun deduct UK VAT,
and add local sales tax, and import duties where applicable. Delivery costs will
be charged in addition; and will be clearly displayed in the checkout section of
the Retrosun site. The final price for overseas customers will be calculated in
accordance with the applicable exchange rate on the day your credit card company
processes the transaction.
(c) Availability
We try to ensure that we always stock the full product range. If for any reason
beyond our reasonable control we are unable to supply a particular item or we
consider the item is not suitable for your needs, we will notify you as soon as
possible. In such circumstances we will not be liable to you except to ensure
that you are not charged for that item.
(d) Payment
We accept Visa, Mastercard, American Express and all debit cards. On receipt of
your order the card issuer will perform the usual verification checks. In the
event of card refusal we are not liable for non-delivery or delay. Your payment
transaction will be processed by the secure payment gateway at Secpay. Retrosun
does not hold credit card information. Your card will be debited once your order
is ready to be shipped.
To ensure that your shopping experience is safe, simple and secure Retrosun uses
Secure Socket Layer (SSL) technology.
(e) Discount and promotional codes
Discount and promotional codes maybe offered from time to time; such codes may
apply in respect of any, or certain specified, purchases made through this
Website. The conditions of use relating to any discount or promotional code will
be specified at the time of issue.
6. Cancellations and Returns
6.1 If you wish to cancel your order:
(a) You can notify us by email to customercare@retrosun.co.uk before we have
dispatched the goods to you; or
(b) Where goods have already been dispatched to you, by returning goods to us in
accordance with clause 6.2 below
6.2 If you are not entirely satisfied with the products you have chosen, you may
return them to us within 14 days of dispatch. We will be more than happy to
offer you an exchange or full refund provided that the products are returned in
their original condition with the Retrosun security tags on. Once this has been
removed customers may only return the item if it is found to be faulty. Please
take extra care to open and check all products within the 14 days as no items
will be accepted back outside of this period.
Retrosun will refund the original credit card used to pay for the goods. The
refund includes the full value of the items returned, but excluding shipping
costs, (with the exception of faulty items). If you order has been sent to a
destination within the EU, all sales taxes will be refunded. Outside the EU,
customs duties and sales taxes are non-refundable through Retrosun. However, you
may be able to recover these by contacting your local customs bureau directly.

The process of returning goods is simple, please see below:
1. Please send an email, To :customercare@retrosun.co.uk Subject: order number
(found on your invoice and order confirmation), Body: please request a returns
number and a brief explanation about why you want to return the product.
Retrosun will reply with your returns number, which needs to be clearly written
on the returns document.
You need to request a returns number within 7 days of receiving the goods.
2. UK customers: Please send to the above returns address within 14 days either
by Royal Mail recorded delivery or your own courier. We cannot take
responsibility for items without proof of delivery and the item is your
responsibility until it reaches us. The cost of returning the item to us is your
responsibility.
Overseas customers: Please book a collection with DHL. To find the telephone
number of your nearest DHL , visit www.dhl.com and select your country.
3. Complete your invoice (the original one sent needs to be in the package)and
your returns information (and fill in the DHL airway bill if applicable) and
sign it.
4. You will be notified by email once your return has been received and
processed.
6.3 Faulty goods
Goods are classified as faulty if they are received damaged, or where a
manufacturing fault occurs
within 3 months of purchase. Please note that sunglasses are a delicate item and
if damaged as a result of wear and tear are not considered to be faulty.
7. Registration
7.1 To register with www.retrosun.co.uk you must be over eighteen years of age.
7.2 Each registration is for a single user only. We do not permit you to share
your user name and password with any other person.
7.3 Retrosun may suspend or cancel your registration at our discretion or if you
breach any of your obligations under these terms and conditions.
8. Liability
While Retrosun tries to ensure that material included on the Website is correct,
reputable and of high quality, it cannot accept responsibility if this is not
the case. Retrosun will not be responsible for any errors or omissions or for
the results obtained from the use of such information or for any technical
problems you may experience with the Website. If Retrosun is informed of any
inaccuracies in the material on the Website we will attempt to correct the
inaccuracies as soon as we reasonably can. We disclaim all liabilities in
connection with the following: incompatibility of the Website with any of your
equipment, software or telecommunications links; technical problems including
errors or interruptions of the Website; unsuitability, unreliability or
inaccuracy of the Website; inadequacy of the Website to meet your requirements.
To the full extent allowed by applicable law, you agree that we will not be
liable to you/or any third party for any consequential or incidental damages
(including but not limited to loss of revenue, loss of profits, loss of
anticipated savings, wasted expenditure, loss of privacy and loss of data) or
any other indirect, special or punitive damages whatsoever that arise out of or
are related to the Website.
Nothing in this paragraph applies to Retrosun’s liability in respect of products
sold through the Website. Nothing in these Terms and Conditions shall exclude
Retrosun’s liability for personal injury or death caused by its negligence.
9. Third party/Linking to this Website
The Website may include links to other web sites or material, which are beyond
its control. Retrosun is not responsible for content on the Internet or on any
site outside the Website. You may link to our homepage, provided you do so in a
way that is fair and legal and does not damage our reputation or take advantage
of it, but you must not establish a link in such a way as to suggest any form of
association, approval or endorsement on our part where none exists. You must not
establish a link from a Website not owned by you. You must not create a link to
any part of this site other than the home page. We reserve the right to withdraw
linking permission without notice.

You agree to indemnify, defend and hold harmless Retrosun, its directors,
consultants and agents, from any and all third party claims, liability, damages
and/or costs (including, but not limited to, legal fees) arising out of your use
of this Website, or the use by any other person accessing this site using your
internet account. We reserve the right, at our own expense, to assume the
exclusive defence and control of any matter otherwise subject to indemnification
by you hereunder.

of the English courts.

The above terms of service constitutes the entire agreement between you and
Retrosun regarding your use of this site and supersedes any and all preceding
and contemporaneous agreements between you and Retrosun. Any waiver of any
